Common Reasons Insurance Companies Fail to Pay Fairly for An Injury Claim

Share |

Your Claim May Be DeniedWhen you faithfully pay your insurance premiums, it’s reasonable to expect that any claim you make will be processed in a timely fashion. But, being the cynical money-grubbing entities that they have become, and to keep costs down companies are often reluctant to pay when you file a claim for accident-related expenses.

When it comes to personal injuries, the biggest reason claims are denied is that the person making the claim did not seek treatment immediately after the accident. Even if you wait just a few days to see your doctor or don’t follow-up quickly enough insurers will argue that your injuries weren’t truly the result of the collision.  Or that you’re exaggerating in hopes of a payout. For this reason, it’s imperative that you seek immediate medical treatment after any accident — even if you feel that your symptoms are relatively minor and will resolve themselves on their own. Documentation of your willingness to seek treatment for your injuries makes it much more difficult for the insurance company to deny coverage.

Preexisting conditions can result in claim denials because it becomes difficult to prove whether or not the claim is for collision-related injuries or the preexisting condition. This is often the case with people who have experienced back pain before and after an auto accident. You are still entitled to compensation for preexisting conditions that have been made worse by an accident, but people often need to see several specialists to obtain the test results and other medical evidence to support an exacerbation claim.

If you fail to follow your doctor’s treatment recommendations, your claim may be denied because of the perception that you’re already recovered or are simply an uncooperative patient. A single missed appointment isn’t reason to deny your claim, but a history of failing to comply with a treatment plan will do serious damage to your case.

Other excuses insurance companies use to deny deny claims include errors in filing paperwork, a lack of witnesses to corroborate your version of the events, a history of being involved in multiple collisions, or arguments that place you partially at fault for the accident. In most cases, these are not valid reasons for denying your claim. A skilled attorney can help you make sure these arguments don’t derail your case.
